Legal Guardianship for Minors
When a child under 18 needs someone other than their biological parents to care for them or protect their assets, the probate court steps in. Note: This is separate from foster care or dependency court.
- Guardianship of the Person: Grants a relative or legal guardian physical custody and the right to make schooling and healthcare choices for the minor.
- Guardianship of the Estate: Appoints an adult to manage money, inheritances, or insurance payouts belonging to a minor until they turn 18.
Conservatorships (For Incapacitated Adults)
If an adult becomes physically or mentally unable to care for themselves or manage their own finances (due to dementia, developmental challenges, or severe illness), the probate court appoints a Conservator.
- Conservatorship of the Person: Grants a person the authority to make medical, housing, and daily care decisions for the incapacitated adult. [1]
- Conservatorship of the Estate: Grants a person the authority to manage the adult's income, pay bills, and protect their physical assets from financial exploitation.
